In 2006, a jury sentenced the 14-year-old to 10 years in custody. Police say he killed his father, Dr. Rick Lohstroh, in west Houston in 2004. Defense attorneys say the child was caught in the middle of his parents' bitter break-up and that he grew up in an abusive household.
"The thing that reversed this case was not allowing our expert to testify regarding his state of mind and how a 10-year old could get to the point where he could shoot his father," said defense attorney Chris Tritico.
The boy is expected to get a new trial. We'll let you know when that trial date is set.
