A Montgomery County grand jury on Tuesday indicted Verna McClain with capital murder.
The indictment accuses McClain of killing Kala Schuchardt and kidnapping the victim's three-day-old son back in April. The shooting happened outside a pediatric clinic.
Prosecutors say McClain planned to pass the baby off as her own.
The Montgomery County District Attorney's Office has not decided whether to seek the death penalty in this case.
