The mother of five children, in the middle of a child custody fight, is free to take her youngsters, according to her attorney. He says Child Protective Services gave the OK for Erica Alphonse to take her children. Rhonda Tavey, a woman who has cared for the family since Hurricane Katrina, is facing kidnapping charges. She was arrested last week after police say she took off with the children.

Tavey filed a motion for custody of the Alphonse children earlier this week.
