Police say the two got into a fight and Brad Davis, 33, then gave his stepfather, Denver St. Clair, 58, an 'atomic wedgie,' pulling his underpants over his head a few days before Christmas.
The force of the wedgie caused him to stop breathing, killing him. Investigators say the underwear was pulled up over St. Clair's head and the waistband was around his throat.
The man told police he meant to give his stepfather the wedgie, but did not mean to kill kim.
A grand jury will decide on charges later this month.
