A judge in Austin on Monday sentenced 22-year-old Joseph Rosales in a plea agreement. Rosales pleaded guilty to two counts of aggravated assault with a deadly weapon in the May 2012 accident on the Butler Hike and Bike Trail in Austin.
Rosales told police he fell asleep when his vehicle struck 80-year-old John Griffith and 42-year-old Diana Pulido. Griffith later died.
Rosales originally was charged with manslaughter and two counts of failure to stop and render aid.
An affidavit says Rosales and another man were walking away from a wrecked car and argued with several witnesses before police arrived.
