A man accused of opening fire on a family's SUV and critically injuring an eight year old girl is now in police custody. Mendez was inside her family's SUV with five other children Sunday morning, when another vehicle pulled up next to them at Hollock and Radio in southeast Houston. Police say 26-year-old Derrick Lopez was inside that other car, and fired on the family. Desiree was hit in the back, dangerously close to her liver.

"My dad said 'get down get down' and when we got down Desiree didn't know what to do so she looked out the window and then right then and there, she got shot," said the victim's sister Reina Mendoza.

Police believe the shooting stems from a fight that happened Saturday night. No one else was hurt.
