Jury downgrades charges in infant's death

HOUSTON The boy, who was originally facing a charge of first-degree murder, will now face a charge of injury to a child. He will still face the same maximum sentence if convicted, 40 years in prison.

On March 12, the boy was being watched by the 10-month-old baby's mother, Shemika Brown. Brown's three other children -- ranging in ages from 4 to 7 -- told police investigators they saw the 12 year old throw the infant to the floor. The baby later died of the injuries.

According to the boy's attorney Ronald Ray, the 12-year-old boy's family said Brown's oldest son was the child responsible for throwing the infant.
