The former Missouri City police officer was sentenced to death in 1996 for hiring a hit man to kill his wife. However, a judge overturned that conviction in 2007, saying confessions from the alleged co-conspirators should have never been admitted as evidence.
The judge also ruled that Fratta was denied his 6th amendment right to confront his accusers since those two men did not testify at the trial.
