Hearing for deputy's accused killer reset for November
HOUSTON (KTRK) -- Shannon Miles did not appear in court Wednesday morning as expected.
Accused deputy killer returned to Harris Co.
His attorney, Anthony Osso, asked the judge hold off on deciding whether or not Miles is competent to stand trial in the murder of Harris County Deputy Darren Goforth who was gunned down in August 2015.
Earlier this week, Miles returned from the mental hospital in Vernon, Texas, where he had been since July.
That hospital is the only facility in Texas where accused violent criminals can get treatment designed to restore competency so the person can stand trial.
Judge Susan Brown said she believes Miles is fit for trial based on the records and evidence she's reviewed. Brown acknowledged Miles could still be found incompetent in the future. While she expressed wanting to move forward, she ultimately agreed to reset the hearing to November 16.
Osso said he hasn't had enough time to meet with his client. Moments before meeting with the judge and prosecutors he said he met with Miles briefly. Osso said he spoke to him through glass and Miles is still highly medicated. This is the first time Osso says he's met with Miles since he was sent to the hospital two months ago.
Miles is now being held at the Harris County jail.
