HPD: Murder charges pending against suspects in deadly drive-by shooting

HOUSTON (KTRK) -- Capital murder charges could be filed against the suspects in the southeast Houston drive-by shooting that left a 6-year-old boy dead and his older brother injured, Houston police said.

Right now, murder charges are pending against 24-year-old Alexis Cuapio and 20-year-old Oscar Ollervides. However, police say they're in talks with the district attorney's office about upgrading the charges against them. They're also still questioning a third person in connection to the deadly shooting.

Police say Ollervides was behind the wheel of a borrowed car as Cuapio sat in its back seat and fired at least 14 shots early Friday morning into a home in the 6200 block of Narcissus.

"I believe their intention was to actually strike the two older brothers," said Travis Miller with the Houston Police Department.

Instead, the bullets struck and killed 6-year-old Moises Jimenez and critically injured his 11-year-old brother, Manuel Jimenez.

"They did express a little remorse that one was deceased, one was hurt, but it doesn't negate the fact they were reckless in their acts and reckless in their discharge of that weapon," Miller said. "They just shot blindly into the home with no regard as to whether or not anybody else was home."

Police say the suspects are involved in an ongoing feud with the victims' two older brothers. They wouldn't discuss details of the feud, saying that the quarrel itself is under an ongoing criminal investigation.

A tip helped police identify the suspects and once arrested, they confessed to their roles in the crime, police say.

The boys' mother, Elizabeth Garcia, tells Eyewitness News she'll be sleeping better at night knowing the suspects are behind bars.

"They're going to get what they deserve. They're going to get them justice. They have something coming for them, they're going to pay for it," she said.

The family is planning to lay young Moises to rest Friday. Services begin at 11am with a viewing, following by a service at the Mass Immaculate Conception Church, 7250 Harrisburg Blvd Houston, and the burial at Forest Park Cemetery.

Manuel Jimenez is still in the hospital, though his condition has improved.
