Army recruiter accused of rape found not guilty

HOUSTON Jurors on Wednesday began deliberating the fate of 34-year-old Phillip M. McAuly, who was charged with sexual assault in connection the August 2009 rape of a woman in north Harris County.

The woman accused McAuly of raping her after he appeared at her apartment with a plastic bag, which he said contained documents the Army needed to complete her sister's enlistment in the military. The woman went to a hospital the next day and had a rape kit exam.

However, the jury didn't find enough evidence to convict McAuly on the charge.
