Houston man facing disturbing charge

HOUSTON It's the first time Harris County courts are considering HIV as a deadly weapon. And the victim is a 15-year-old child.

No one answered the phone at the home of Kevin Lee Sellars, 49, Tuesday. Sellars is charged by Harris County with sexually assaulting the teen with a deadly weapon. The weapon -- HIV, the virus that causes AIDS.

"On December 30, the 15-year-old was returned to Indiana, where he lived," said Assistant Harris County District Attorney Eric Devlin. "Upon coming back, he was actually threatened by the defendant and told that the defendant is HIV positive."

Investigators say it all began on MySpace. On Sellars' still active profile, he describes himself as someone who likes to have fun, and enjoys the company of young boys.

"He actually met on MySpace, through MySpace profiles," said Devlin. "They engaged in an online relationship, talking, that type of thing, until he actually flew the child down."

Investigators say the victim wasn't aware that Sellars was HIV positive until the relationship went south, Sellars then told the victim. In addition, prosecutors believe Sellars also engaged in child pornography.

"At the search warrant, they did locate actually printed forms of child pornography, eight- and nine-year-old boy engaged in sexual acts," said Devlin.

The allegations are a shock to neighbors, who say they knew nothing about Sellars until a police made the arrest.

Included among the evidence collected with the search warrant was proof that Sellars is indeed HIV positive.

Sellars is charged with aggravated sexual assault of a child and possession of child pornography. He's in custody on $35,000 bond.
