Biological evidence from the 1987 conviction of Gary Alvin Richard was re-tested after an independent report uncovered mistakes at the Houston Police Department's crime lab. Richard's defense attorney says the new tests clear his client.

Prosecutors plan to ask a judge to release Richard on bond at a hearing Thursday. They have not decided whether to re-try him or drop the charges.
