A man is accused of sexually assaulting a boy in the band room of Sharpstown High School, when he was just a teen himself.

Jesus Acosta-Herrera, 24, is charged with sexual assault of a child. Court documents state in December 2005, Acosta-Herrera, who was 19 at the time, sexually assaulted a 14-year-old boy at Sharpstown High School.

According to court documents, the victim saw Acosta-Herrera in the band room and told him his birthday was coming up. Acosta-Herrera allegedly told the victim that he had a birthday present for him and sexually assaulted him.

The victim stopped the assault and left the room, court documents state.

Acosta-Herrera's bond has been set at $30,000. He has no previous criminal history.

The victim in this case has the same name and same date of birth as the alleged victim in another case connected to Sharpstown High. Former HISD employee Anne Montgomery is charged with improper relationship with a student in that case.
