The officer, James Anthony Rodriguez, no longer works for HPD, but the department confirms to us there is an internal affairs investigation.

Rodriguez is charged with aggravated sexual assault. According to a court affidavit, the incident occurred September 6, 2008. The report says Rodriguez coerced the female victim into having sex with him, at one point producing a deadly weapon.

Rodriguez was hired at HPD back in February of 2007. He resigned on November 21, 2008, two months after the alleged incident. Houston police couldn't tell us if Rodriguez had any previous disciplinary problems. And because the investigation is ongoing, the department wouldn't comment on the particulars of the case.
