Deputy Erika Serrato's family filed a suit almost two months after the MCSO deputy was hit and killed while assisting with a DWI crash on I-45.
The constable's office said a van driver and a Pct. 5 deputy are in the hospital after the two collided near Bissonnet overnight.
The suspect began fighting with the deputies, which led to one being hit in the head and falling to the concrete, before fleeing the scene, officials said.
Authorities said the officer's vehicle flipped and rolled for almost a whole block. Police say the officer had his lights and sirens activated when the crash happened, but they haven't said who may have been at fault.
Police said an attempted traffic stop turned into a slow-speed chase in South Houston before shots were fired by the driver and law enforcement overnight.
The sheriff's office said the deputy had minor injuries. The other driver involved allegedly displayed signs of intoxication.
