SUGAR LAND, TX (KTRK) -- The head basketball coach at Fort Bend ISD's Kempner high school has been placed on leave by the district following his arrest on a sexual assault allegation.

Investigators with the Fort Bend County Sheriff's Office say Toby Villa, 49, was arrested September 19th after the wife of one of his friends came forward claiming she was attacked one night while she was asleep. According to court documents the woman told investigators she "was intoxicated" the night of September 13 when she went to bed. She said she woke up then around 3 am the next morning -- in the dark, to what she thought was her husband removing her clothing.

She told investigators she had sexual contact with the man but felt like "something was wrong" and when she spoke to him the man got out of the bed and left. According to court documents the woman ran after the man and realized it wasn't her husband at all: she identified the man as a friend of theirs, Toby Villa. The woman told detectives she never consented to having any type of sexual contact with Villa that night.

Villa's attorney says his client is devastated by the allegations. Lawyer Casey Kiernan says his client denies the woman's claim. Kiernan says Villa insists the sex was consensual.

Fort Bend ISD says since the alleged incident did not involve any students and was not said to have occurred on campus, it takes all allegations against employees seriously. A spokesperson says Villa has not been on campus since FBISD learned of the allegations.
