HARRIS COUNTY, Texas (KTRK) -- A grand jury has failed to indict a Harris County Sheriff's Office detention officer who was accused of pointing a gun at an assumed shoplifter earlier this year.

Court documents show Roger Johnson is no longer charged with aggravated assault with a deadly weapon after the grand jury returned a no-bill.

Johnson was arrested back in July after he allegedly took out a gun during an altercation with a man and a woman at an Academy store.

A magistrate previously said Johnson thought they were shoplifting, and alleged that the woman reached for something, prompting him to pull his weapon.

Johnson, the man, and the woman were all arrested and charged.

Records show the grand jury asked the court to discharge Johnson and release him from custody.
