Judge says deputy facing child porn charge can't be alone with family member

HOUSTON (KTRK) -- A former Harris County Sheriff's deputy charged with child pornography was in court on Thursday.

Prosecutors say Andrew Sustaita Jr. had more than 200 images of child pornography on his personal computer.

On Thursday, the judge said Sustaita cannot be around a 10-year-old family member without supervision. The judge also said his wife, mother or father can supervise visits with the child.

Former prosecutor and founder of Justice for Children, Randy Burton, says he thinks there could be more to come.

Investigators found images of a child with part of their pajamas pulled down, prosecutors revealed on Thursday.

Prosecutors said that child is related to Sustaita and for that reason they felt he should only have supervised visits with the child family member.

However, the District Attorney's Office says the photo of the relative does not meet the legal definition of child pornography and the image was not used as a basis for the charges he faces.

Burton says he's watching this case closely.

"Tells me this is the tip of the iceberg. This is a very young investigation and it's something that we're going to have to follow closely, but I think we're going to find out it's something more serious," said Burton.

Sustaita also faces an obscenity charge. He's accused of recording video of a sexual act with a dog on his work computer.

The judge also said she does not want Sustaita to use the Internet and requested he not use it.

Sustaita is out on bond on all charges.
