HOUSTON, Texas (KTRK) -- The capital murder charge against Jeremy Jones has been dropped in Sunday's deadly shooting at a northeast Harris County apartment complex.
The Harris County DA's Office says the charges were dismissed because it was a case of mistaken identity.
Jeremy will remain in jail for an unrelated charge of unauthorized use of a motor vehicle.
Jeremy, 28, and Harvey Jones, 34, were formally charged in the shooting rampage that killed two men at the Haverstock Hill Apartments on Aldine Bender.

A judge has ordered both men be held without bond after they were arrested early this morning.
Investigators have still not said how or where the Jones brothers were found.
