Officer cleared in deadly shooting outside Galveston Co. night club

GALVESTON, TX (KTRK) -- A grand jury did not indict the officer involved in a shooting outside a club in Galveston County in December.

Officer Christopher Ham shot and killed Carlton Smith, Jr. outside HT's Lounge the morning after Christmas. Eyewitnesses testified that the officer ordered Smith to drop his gun twice before Smith fired shots into the crowd. That's when Officer Ham shot Smith.

No further criminal action will be taken.
