According to court documents, on October 21, the boy's father, Mark Anthony Justice, told police the baby wouldn't stop crying and he wouldn't accept his pacifier. A Houston police investigator says Justice said he aggressively shook the infant in one arm while he struck the baby on the back multiple times and dropped him on the floor.
Justice got the attention of the child's mother who was in another room and gave her the child, who stopped breathing, according to court documents.
The mother told police that her baby "died in her arms." An ambulance was called and the mother started CPR until the ambulance arrived at the home in the 4900 block of Noble.
Justice is charged with injury to a child and in jail without bond.
