Friday night, we received this statement from Horn's attorney: "The facts remain the same in this case as they were on November 14. Joe Horn shot in defense of his life in his own yard."
We've also learned another local law enforcement agency had its eyes on one of the suspects.
Torres, a Columbian national who was in this country illegally, was one of two suspected burglars shot and killed by Horn.
We compared Torres' picture to a composite sketch of an aggravated robbery suspect wanted in several burglaries stretching from Harris to Fort Bend County, a criminal known to target Asian families. Victims described the attacker as a black man with a Spanish accent. Investigators believe he's part of a Columbian crime gang.
Torres is Colombian and an Asian family lived in the Pasadena home he and Ortiz allegedly broke into.
"There's enough of a resemblance to warrant looking into it," said Chief Deputy Craig Brady with the Ft. Bend County Sheriff's Department. "The facial structure resembles that of the guy on the right."
Though he can't say for sure, Chief Brady believes Torres and this suspect may be one in the same. In fact, his agency recently launched its own investigation. "We're already looking at them for some burglaries but they haven't tied them to any home invasions yet," he said.
Sheriff's investigators also showed us another composite sketch, one of a burglary suspect. They don't know how many burglaries he may be involved in, but as they work to try and tie Torres to some cases, detectives must first go back and check to see what evidence they have for each one.
"There may be prints, there may be some hair. We don't know what evidence they recovered," said Brady.
The Texas penal code says someone can use deadly force to protect a third party's property. To do so, you have to meet certain conditions, one of which is "to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property."
Pasadena police plan to hand over the findings of its investigation in this specific case to the district attorney on Monday. That means we could be one step closer to finding out whether Joe Horn will or won't be indicted.
