Seven-year-old Joseph Harden dove into the shallow end of the pool while his mother was not looking and suffered a serious head injury.
He was taken to the hospital in critical condition.
According to Child Protective Services, Joseph was pronounced dead Saturday.
His mom -- 33-year old Linda Harden -- was charged with injury to a child by omission.
Investigators said her son gained access to the pool because she climbed a locked fence surrounding it.
She could now face additional charges.
