State board votes to close special ed school

HOUSTON The Texas Education Agency said it determined the school is no longer financially viable and voted to close it on Tuesday. The school's attorney filed for a temporary restraining order to keep the school open.

"We're askin' all of the students, all of faculty, all of the staff to show up at seven o'clock tomorrow when the doors open at Benji's Academy and operate with businesses as usual," supporter Richard Johnson said.

The state commissioner of education said, "This action protects the health, safety and welfare of the students. We intend to ensure that each and every student has the opportunity to receive a quality education."
