The 45-year-old Mark Kerrigan had already been charged with assault. He was freed on bail a day after he completed a psychiatric evaluation.
Since then, he has been living with his mother in the family's Stoneham home, where the alleged assault took place.
The Kerrigan family has insisted they do not blame Mark Kerrigan for the death of his father, who had a pre-existing heart condition.
