New documents reveal details about the Harris County Treasurer Carla Wyatt's latest DWI arrest

TEXAS CITY, Texas (KTRK) -- New documents obtained by ABC13 reveal details surrounding Harris County Treasurer Carla Wyatt's latest DWI arrest.

Over the weekend, ABC13 reported that Wyatt was booked into the Galveston County jail on a DWI charge. On Monday, we learned more about the incident.

According to records obtained by ABC13, Texas City police received a call about a vehicle in the left lane of Highway 3 around 1:30 a.m. on Saturday. An officer responded and noted the officer, "approached the driver's side of the vehicle, observed a female in the driver's seat, the ignition on, and the female to be asleep."

The documents go on to say the officer "woke up the female and asked where she was at and advised she was in heaven. [The officer] asked the female repeatedly where she thought she was at and advised she was in Houston and en route to Galveston for a conference at 1130."

According to the documents, Wyatt told the officer she had one glass of wine at dinner. Later during the stop, the documents show the number changed to two glasses of wine.

The documents state the officer "smelled the odor of an alcoholic beverage emitting from her person. While Carla was standing outside her vehicle, she used the vehicle to maintain her balance by sitting on the rear bumper."

After failing the field sobriety test, Wyatt was arrested for DWI. Jail records show Wyatt is no longer in the Galveston County jail.

ABC13's Nick Natario spoke to Wyatt on the phone. She wouldn't answer his questions about the arrest and pointed her to her attorney.

Wyatt's attorney, Christopher Downey, sent ABC13 a statement:

"We are looking forward to obtaining all of the available discovery in this case and investigating the basis for this arrest. Dr. Wyatt denies that she committed any criminal act whatsoever."

This isn't Wyatt's first run-in with the police. Two and a half years ago, records show she was charged with a DWI for driving while nearly twice the legal limit.

She agreed to complete a court-issued program to get that charge dropped. Then, last December, records show she was charged with burglary of a vehicle.

A grand jury declined to indict her in April. A charge that prompted commissioners to discuss the county treasurer position in January.

At the time, Judge Lina Hidalgo said she wanted to see what happened in court.

"I think changing her duties is a pretty serious step," Hidalgo said. "Whatever comes out in the courts will affect my decision. It's just a little bit early."

While commissioners may discuss her duties, experts said they can't suspend Wyatt. The county attorney or DA could start the process, experts explained, but if she wins re-election this November, the suspension would be thrown out.

"The logic being that voters knew about it and they still voted for her," Rice University political science professor Mark Jones explained.

Commissioners will meet on Thursday. So far, there's no mention of discussing Wyatt's duties as treasurer on the agenda.
