Capital murder trial dates set for Hockley, Cypress men

CONROE, TX -- A pair of co-defendants accused of being accomplices in a capital murder case are schedule for trial Oct. 27 in Montgomery County's 221st state District Court.

Mikhail Demond Drake, 22, of Hockley and Justin Ray Story, also 22, of Cypress are both charged with helping David James Williams Jr. kill 37-year-old Alfredo "Tony" Medina during a robbery at his Magnolia home November 25, 2012.

The Montgomery County District Attorney's Office considered last year whether the three men could face the death penalty if convicted, but Williams pleaded guilty to murder and 60 years in prison April 29.

Drake, who is also schedule for a hearing Oct. 10 to suppress statements gathered through the investigation, could stand trial first if Judge Lisa Michalk accepts Montgomery County prosecutor Jim Prewitt's suggestion.
