GALVESTON, TX (KTRK) -- A Galveston police officer who shot a man who had been driving the wrong way on the Gulf Freeway won't face charges.

A Galveston County grand jury no-billed Captain Jeffrey Heyse for the incident back on May 15. According to investigators, a man, identified as Nelson Ray Anderle, 33, was driving the wrong way on I-45 on the causeway.

Heyse, who was off-duty at the time, noticed Anderle's vehicle going in the wrong direction and shot out his tires to get him to stop, which he did near the Texas City Wye. Both Anderle and Heyse got out of their vehicles and investigators say Anderle began to charge Heyse, who identified himself as an officer.

Anderle reportedly didn't stop and Heyse opened fire, hitting him once.

Anderle, who survived his injury, was indicted on two counts of aggravated assault with a deadly weapon.
