HOUSTON (KTRK) -- There are new developments in the murder investigation of Harris County Sheriff's Office Deputy Darren Goforth. We've received new documents in the case and have a new photo from the crime scene showing the woman everyone is talking about.
Deputy Goforth was murdered on August 28 in northwest Harris County. Shannon Miles is charged with capital murder in the case.
Miles' attorney is asking questions about how the woman who claimed to be having an affair with Goforth was handled the night of the shooting. An eyewitness shared s photo of her from that night. It shows her at the crime scene and distraught.
Defense attorney Anthony Osso wants to talk to anyone in law enforcement who talked to her that night. Who told her to leave the scene of the murder or why?
"We want to know who spoke to her, who instructed her, if anyone instructed her to leave the scene or transported her from the scene. We want to know about it," Osso told Eyewitness News.
The alleged mistress is central to the defense right now because if Goforth was there to meet her, Osso argues, the deputy wasn't officially on duty. Therefore, Miles charge should be downgraded.
There have been persistent questions within the case about whether she was given special treatment after investigators at the scene learned of her relationship with Goforth. There is also a possible hint they tried to hide her.
"At this point, I'm going to give them the benefit of the doubt and do my own homework," Osso said.
The sheriff's office denies any wrongdoing and the Harris County District Attorney's Office has no comment.
Osso questions the timeline in the new papers filed on Wednesday. He says it took the sheriff's office almost two weeks to tell the D-A about the witness.
"I haven't been given an explanation for the delay and you would think in a police-related shooting, your D-A would have this information available to them immediately," added Osso.
