PORTLAND, OR (KTRK) -- The owners of a day care in Oregon admit to smoking medical marijuana when children are there -- and it may be legal.

Charity Araujo's license has been suspended while the state investigates, but she says they follow all the rules. Her license says a second adult must be the primary caregiver when the license holder is under the influence.

She says they do that and she and other staff members smoke away from children in a canopy outside the day care.

"When we medicate, our kids are in the house, nap time," said Araujo. "Our kids are in the house cause they're done for the day."

Araujo says she isn't worried about the investigation. The state investigated once before and she says it didn't find anything wrong.
