GALVESTON, TX (KTRK) -- Galveston police are trying to identify one of two pedestrians struck by a car Sunday night near the seawall.

It happened around 8:30pm in the 6100 block of Seawall Boulevard.

Police say the driver of a red Cadillac tried to stop before striking the two people as they crossed the street but it was too late. The driver remained at the scene and appeared to be sober. However, witnesses told police they saw the victims carrying beer and stumbling in the roadway just before the accident.

One victim, 57-year-old Galveston resident Paul Ward, was conscious on the scene and couldn't remember details of the accident. The other pedestrian, who is yet is to be unidentified, was unconscious.

Both victims remain hospitalized at UTMB; the unidentified pedestrian is still in critical condition.

Police say the driver will not be cited in the accident because an initial investigation suggests the pedestrians weren't using a crosswalk and did not yield the right of way to oncoming traffic.
