Family of 18-year-old killed in Alvin crash says they hope driver will be held accountable

ALVIN, Texas (KTRK) -- A family is demanding justice following the death of an 18-year-old in a deadly crash in Alvin, they say was preventable.

According to law enforcement, the crash happened on June 11 on County Road 949K in Alvin.

Law enforcement says the driver of the truck that Kadin Oxsheer was in was not paying attention and had been drinking.

A memorial now sits where Oxsheer lost his life. His family says a few weeks before his death, he had just turned 18 years old, graduated high school, and was excited for the future.

It's been two months since his family says he fell out of a truck his friend was driving and died.

"5:30 that morning I get a call from the state trooper saying Kadin had been in an accident and he was critical," Kadin's mom, Crystal Oxsheer, said. "It was shocking. Nurses said your son came in; he wasn't alive. We worked on him for an hour and a half; we brought him back. He has 10 percent."

Oxsheer says her son's injuries were so severe he didn't pull through at the hospital.

"We don't know why, but we can't bring him back, so we just fight for justice for him," Oxsheer said. "It hasn't been easy. It's been very hard."

A DPS crash report shows one of Oxsheer's friends was driving his truck down County Road 949K on June 11.

According to troopers, Oxsheer was sitting on the windowsill of the door when the driver accelerated, and he fell out.

The report says she continued to drive and then crashed into a telephone pole.

"When she kept going, she dragged his body from one side to the other side of the road," Oxsheer said. "The troopers had a conversation with her and then admitted she knew Kadin, and she was driving. It was because she was under the influence of alcohol."

Two other teenagers were also in the backseat, but were uninjured.

"Holding the driver responsible for what she has caused," Oxsheer said.

The crash report says the driver had been drinking and had a .11 blood alcohol level, which is above the legal limit for someone under 21 years old.

Oxsheer's family says the case is now in the hands of the Brazoria County DA's office as they await its presentation to a grand jury.

ABC13 has reached out to the DA's office repeatedly and has not received a response to our multiple requests for comment.

"One day, every day is a day closer to him, so I am holding on to faith," Oxsheer said. "Very sweet, beautiful eyes and beautiful smile. You would have loved him."

As they wait for what will happen in Oxsheer's case, this hurting mom amid her unimaginable grief just welcomed her fourth son in late July, whom she named in Kadin's honor.
