A beating inside Philadelphia's largest prison is prompting an investigation and talk of a lawsuit and the suspect is a prison guard.

PHILADELPHIA,PA -- A beating inside Philadelphia's largest prison is prompting an investigation and talk of a lawsuit.

The suspect is not an inmate but a prison guard.

Cameras captured the incident inside Curran Fromhold Correctional Facility on September 20th.

It shows Officer James Weisback repeatedly punching inmate Jonathan Akubu, while he was cuffed.

According to Akubu's attorney Guy Sciolla, the initial guard report on this incident does not match the video.

"He also then goes on to say that he administered an open handed blow to Mr. Akubu - one blow. If you look at the video, there are 15 closed fisted punches at short range while Mr. Weisback has Mr. Akubu in a headlock," said Sciolla.

Weisback claims Akubu spit at him.

A prison report indicates that Akubu was being taken to the infirmary, after purposely clogging his toilet and being pepper sprayed.

The prison says Weisback was suspended for a brief time for using excessive force, and then placed in another unit.

Akubu's attorney plans to file a federal civil rights violation lawsuit.
