12-year-old girl arrested for pinching boy's butt in school

LONGWOOD, FL (KTRK) -- A 12-year-old girl who was arrested for pinching a boy's butt in school says it was all a joke.

Did the arrest go too far?

According to the boy's mother, the joke that Breana Evans played on her son wasn't funny.

Ray Evans, Breana's father, says deputies told him the mom wanted to press battery charges.

"That's what the deputy told me," Ray Evans added. "He said, 'I don't even want to do this.' That's what the deputy said. 'But I have to do what i have to do.'"

After the boy alerted school officials, Breana was suspended.

"I regret it because I didn't know it would lead to this," Breana said.

She was booked into juvenile detention and charged with misdemeanor battery.

According to the Seminole County state attorney, if Breana completes a diversion program, including community service and passing drug tests, the charge will be dismissed and her record would be clean
