TOMBALL, TX (KTRK) -- A man was shot by police after authorities say he refused to drop his weapon last night in Tomball.

It all started around midnight with a domestic disturbance call at the Marymont Apartments complex on Highway 249 near Rudel.

The Tomball Police Department says when the officers arrived on scene, the suspect started running.

Officers chased after the suspect and say during the pursuit. The suspect allegedly had a gun and waved it at officers.

Tomball police say they told the man to drop his weapon several times and when he refused, an officer shot him.

Tomball Police Department Captain Rick Grassi said, "Upon arrival, the officers were able to locate the suspect. He failed to comply with their commands. A brief foot pursuit took place in which the suspect brandished the weapon toward the officers, and shots were fired and the suspect was struck."

The suspect was critically wounded and flown to Memorial Hermann Hospital. He is in critical condition. The suspect was identified as Danny Miguel Saul, of Hockley, Texas.

The officer was not hurt.

The incident remains under investigation.
