Man struggles during arrest, shot twice by off-duty deputy constable

Deputy shoots, kills during struggle
An off-duty deputy constable opened fire on a man that began fighting while being arrested

HOUSTON (KTRK) -- An off duty Precinct 4 Deputy Constable opened fire on a man at an apartment complex. That man later died at the hospital

It happened around 3am this morning at the Village in the Woods apartments in northwest Harris County.

Precinct 4 says the constable was working a second job at the complex as a security guard. The deputy was in the process of making an arrest when there was a fight between him and the man he was arresting.

The deputy fired two shots, hitting the man twice in the stomach. Medics took him to Ben Taub Hospital where he died.

The deputy suffered minor injuries during the struggle including a hurt back and scraped up arms. Medics took him to Willowbrook Methodist to be checked out.

The Harris County Sheriff's Office is now investigating.
