Deputy Aileen Jimenez Barboza, 36, has been charged with murder in the case of 36-year-old Levincar Swanson.
ABC13 first reported on this story in February 2025. According to officials, someone at the gas station off I-45 North Freeway and West Road called and said that a man was acting erratically and damaging the gas pumps.

ABC13 cameras at the scene showed the damaged pumps, with one of the pumps' wires ripped out of the station. Officials said that Swanson did it with his bare hands.
Barboza and another deputy arrived, and Swanson initially complied with their commands; however did began resisting arrest, as seen on surveillance footage, released last April.
At one point, a struggle ensued where the deputies used their Taser on him, but the man was able to disarm the Taser from one of the deputies, causing the ordeal to escalate, officials said.
Officials said Barboza discharged her weapon and shot Swanson four times in the torso. He later died after he was taken to the hospital, officials said.
Barboza wasn't hurt, but the second deputy was, officials said.
An Internal Affairs review said that Barboza violated multiple policies during the shooting. Following the shooting, she was placed on non-law enforcement duty immediately after and remained in that role until she was fired on Thursday, March 19, 2026, officials said.
Barboza had been with the sheriff's office since 2010, according to officials. She has appeared in court and had her bond set at $50,000.
