Whole Foods to take legal action amid allegations that gay slur was written on cake

AUSTIN, TX (KTRK) -- Whole Foods filed the suit after releasing a video they say proves they never wrote a homophobic slur on a customer's cake.

The pastor's attorney says he is aware of the countersuit and the video and is investigating the allegations.

Meanwhile, Whole Foods filed a defamation lawsuit against the pastor and his attorney seeking sanctions and at least $100,000 in damages.

"The struggles we go through are not easy. And as a 30 year old openly gay pastor, I've had to face years of discrimination and judgement for something I had no control over," said Pastor Jordan Brown.

The Austin-based company released security camera footage of Pastor Jordan Brown buying the cake in question.

"The bakery associate stepped away, wrote on the cake, sealed it with a Whole Foods price sticker, handed it to Pastor Jordan who purchased it with his credit card," said Austin Kaplan, Pastor Jordan Brown's attorney.

Whole Foods said in a statement that the video shows the UPC code on the cake is on top of the box. Not on the side and bottom, as displayed in Brown's YouTube video.

They say the entire story that a gay slur was written on the cake by an employee is false.

And even snapped a picture of employees with the hashtag, #lovewins.
