Two families have lost loved ones, blame each other for killings

ANGLETON, TX (KTRK) -- In a small courtroom in Brazoria County, two families are forced to sit together. Both families have lost loved ones, and both blame the other family for it.

"It's not just us hurting," said Cindy Barajas, whose husband is on trial for murder. "I'm pretty sure the other family is hurting as well."

David Barajas is on trial for the murder of 20-year-old Jose Banda. Back in 2012, investigators say Banda was drunk when his car slammed into the Barajas family vehicle on a dark Alvin road. David Jr, 12, and Caleb, 11, were killed instantly.

Prosecutors allege the angry father ran home, grabbed a gun, then shot and killed Banda. Barajas denies it, saying he was focused on his two sons and doesn't know who killed Banda.

"I live in a daze on a daily basis," said Cindy Barajas. "You know, walking around like a chicken with its head cut off, I guess you could say."

Investigators have not found a weapon. On Friday, a forensics expert testified that Barajas did not have gunshot residue on his hands after the shooting.

Jurors also heard from an evidence collector for the Brazoria County Sheriff's Office who visited the Barajas house directly after Banda's death.

"I did not observe any possible blood or anything that appeared to be from the scene," said investigator Jack Gentry.

The trial continues on Monday, when the state is expected to conclude its case.
