HOUSTON (KTRK) -- Houston gospel singer James Fortune was back in Fort Bend County court Wednesday to seek permission to see his four children.

The Grammy-nominated singer was charged with aggravated assault family violence in October, and hasn't been allowed contact with his children since the alleged incident happened.

Fortune's wife Cheryl, the alleged victim, testified on his behalf. She told the judge that the kids were present when the alleged incident occurred, but were not harmed. She also said she believes it's in the best interest of the children for them to have visitation with their father.

Judge Hawkins granted Fortune's request. He will be allowed to visit the children with members of his wife's family present only.

Neither police, prosecutors, or Fortune's attorney have confirmed what he allegedly did to his wife to lead to the charge.

He's currently out on $20,000 bond.
