Houston city council considers secured load ordinance, making unsecured cargo illegal

HOUSTON, Texas (KTRK) -- A Houston city councilmember is proposing a local ordinance to penalize people with unsecured loads on their vehicles.

"We've seen so many accidents reported, not only just on our streets and roads but on our expressways," Houston City Council Representative At-Large Position 2 Willie Davis said.

The ordinance proposal states that it seeks to amend Chapter 45 of the code of ordinances to create a local law to combat the issue.

The proposal states that "the proposed ordinance requires that motor vehicles, and/or any attached trailers, secure loads or cargo with a securement device of sufficient strength to prevent their loads from moving, thus preventing them from ending up on the roads and/or highways."

Council Rep. Davis told ABC13 it includes loose objects such as furniture, mattresses, containers, and more.



"The ordinance enables HPD that when they see someone with those types of objects loosely on the back of their trucks or vehicles, they will be able to give them a citation, in other words, in order for them to secure it," Davis said.

There were 1,385 crashes in the state of Texas in 2024 due to "loads not secured," according to TxDOT.

Davis's proposal is expected to be sent to a city council committee on July 28, and he said it will go to a vote in the full council shortly after.

He said he expects the ordinance to be implemented in the fall.
