Christian Castro is charged with four counts of second-degree assault and one count of falsely reporting a crime out of Hennepin County, Minnesota.
He is accused of shooting Julio Sosa-Celis through the front door of a house in January, according to the county attorney's office.
Castro has not been extradited to Hennepin County because his paperwork is awaiting a signature from Governor Greg Abbott's Office.
Tom Hogan, an assistant professor at South Texas College of Law, said it is standard for the governor's office to sign off on extradition paperwork.
"Normally that just happens sort of in the ordinary course of things," Hogan said. "It can take some time, and it can be contentious when people have political disagreements, basically."
Thursday, Hennepin County Attorney Mary Moriarty sent a letter to Governor Abbott asking him to sign the paperwork "immediately." This is not the first letter Moriarty has sent asking for Castro's return.
"The process has been initiated in full compliance with both Texas and Minnesota statutes, and all procedural requirements have been met," the letter reads.
Moriarty's letter goes on to say that court proceedings are at a standstill with Castro being held in Texas.
Hogan said the fact that a letter was sent to the governor indicates to him that a political issue is holding up the process.
"We have a lot of differences in the United States, and you can see people starting to get political about this stuff as the criminal justice system becomes more politicized," Hogan explained.
He said it would likely be more impactful for Abbott to receive a letter from the Governor of Minnesota.
"But, the governor of Minnesota is Tim Walz right now," Hogan said. "Once again, although they probably know each other, I doubt Governor Abbott and Governor Walz see eye to eye politically. I would doubt that they are, you know, having drinks together at the Governor's Association Meetings."
13 Investigates asked Governor Abbott's office if they intend to sign the paperwork and why it has not been signed already. They responded, "The Office of the Governor does not comment on pending extradition matters."
When asked for a comment, Moriarty's office said, "We look forward to Mr. Castro arriving in Minnesota to begin court proceedings."
