HOUSTON (KTRK) -- Surveillance video showing a Klein ISD bus driver appearing to put children in danger is going viral and now some parents are asking if the driver could face criminal charges.

Video shows the bus come dangerously close to a moving train and the driver appears to be unconcerned.

Nobody was hurt in the incident and the driver has been fired.

"I do think there needs to be a legal investigation. Whether or not criminal charges are filed, I'm not to say, but maybe the Harris County DA's office needs to look into it," explained Gail Rowland, whose 14-year-old son was on the bus.

Eyewitness News Legal Analyst Joel Androphy says there's a good chance the driver could be charged with child endangerment, because some of the students were under 15.

"You should not be able to escape criminal responsibility just because nothing happened," explained Androphy. "What if something did happen? The law is meant to prevent people from being in danger."

We have reached out to the Harris County DA's office, but it's still too soon to say whether charges will even be considered.
