A suspended horse jockey won't be back on a Texas race track any time soon after a photo surfaced that appears to show him using a device to shock his horse

HOUSTON (KTRK) -- A jockey photographed shocking his horse to the finish line in a Houston race won't be back on the track anytime soon.

The racing commission Monday suspended Roman Chapa for five years and fined him $25,000.

Chapa has until Thursday to appeal the ruling.

A criminal case is still pending.
