HOUSTON (KTRK) -- A Harris County deputy constable is still in Memorial Hermann Hospital after being hit by an out of control driver Sunday night.

Sergeant Jeremy Talbert had surgery in the back of his head early Monday morning. Precinct Four Constable, Mark Herman says he has a breathing tube in, is in critical condition, but he's stable. Herman says in the beginning, things didn't look good.

"Just the amount of blood there at the scene immediately you think possible brain injury," Herman said.

Talbert was flown to the hospital minutes after the accident. The driver who slammed into him was arrested. That man is Vincent San Felippo, 20. Investigators say he was likely intoxicated when he crashed.

"Some comments that he made to us that he had been doing drugs gives us a strong indication that he was under the influence of something," Herman said.

Talbert has a long road ahead. Dozens of members, friends, fellow deputies stopped by the hospital Monday morning to wish him well.

"Obviously the man upstairs was looking out for Sergeant Talbert," Herman said.

As of Monday morning, San Felippo was still in the hospital. Pending toxicology reports, investigators say he'll likely be charged with intoxicated assault.
