Detectives make arrest in deadly Katy home invasion, shooting

KATY, TX (KTRK) -- An arrest has been made in the murder of a 21-year-old Katy man shot during a struggle with a pair of masked men who forced their way into his apartment Saturday night.

Andrew Kizer, 23, was taken into custody Thursday and charged with capital murder.

At the time, homicide investigators said there were three people at the apartment when the intruders arrived. The occupants were ordered to "get on the floor."

Instead, they struggled with the intruders. During that struggle, the suspect alleged to be Kizer fired his gun. Twenty-year-old Christian Burke was killed. Brandon Fries, 21, was shot in the ear.

Kizer, court documents state, was beaten in the head during the fight. He got away, but a gun that's said to be traced to a family member, was left behind.

The report filed by homicide investigators states that Kizer drove to Austin, where he went to the emergency room at St David's Hospital. There, he told a doctor he had been beaten with a beer bottle.

When he returned to the Houston area, he was found by investigators, questioned and arrested.

Kizer is being held without bond in the Harris County jail. The second suspect remains at large.
