Suspects accused of trying to rob off-duty HPD officer and girlfriend arrested at hospital

Charges have been filed against three teen who investigators say tried to rob an off-duty officer and his girlfriend outside a southwest Houston movie theater over the weekend.

Ruben Anthony Zelaya, 17; Macedonio Rivera, 18; and Luis Angel Aquino, 17; are all charged with aggravated robbery with a deadly weapon.

The charges stem from an incident that happened outside the Edwards movie theater on Weslayan and Portsmouth early Sunday morning. According to investigators, Officer J. Johnson was with his girlfriend when three suspects pulled up next to them.

One of the suspects, identified as Zelaya, pointed what appeared to be a pistol at the pair and demanded the girlfriend's purse. That's when Officer Johnson fired his weapon at Zelava.

Zelaya and Rivera suffered non-life threatening injured in the shooting. Aquino was not hurt. The three drove to Memorial Hermann Hospital, where they were arrested.

Police say they found a pistol not too far from the scene and at least two of the suspects showed up at the hospital with non-life threatening injuries. A third suspect who was not injured is currently in police custody.

The officer and his girlfriend were not hurt.
