The driver of a sport utility vehicle that plunged into a pond on an immigrant-smuggling run, drowning three men, has been sentenced to prison.

A federal judge in San Antonio sentenced Javier Silva-Morales to 12 years in prison on Wednesday. The 31-year-old resident of the Mexican state of Michoacan had pleaded guilty to one count of immigrant smuggling resulting in death under an agreement with prosecutors.

Still to be sentenced Sept. 11 is 25-year-old Monterrey, Mexico, resident Jose Abram Lopez-Lozano after he pleaded guilty to one immigrant-smuggling count.

Three of 12 people in the SUV drowned Feb. 6 when it plunged into a stock pond after a police chase about 35 miles southeast of San Antonio.
