Court records indicate a Nueces County grand jury on Thursday indicted 47-year-old Laura Lee Day of Corpus Christi.
Her lawyers said Friday they were surprised by the capital murder charge and did not think her 1982 second-degree murder conviction figured. She was also convicted in 1993 of bigamy in Maryland.
Day could face execution if convicted in the Oct. 5 death of Taylor Syring. Police say Day told them she let the boy remove his life jacket while swimming alone in shallow water as she watched him.
